SANTA FE, N.M. -- A Santa Fe murder case is reigniting efforts by lawmakers to change the laws when it comes to crimes against pregnant women.
Sarah Lovato, 17, and her father were killed in a Santa Fe apartment last May.
Sarah was more than eight months pregnant at the time and police said the teen's boyfriend Marino Leyba shot them. Now he is facing two murder charges and no charges for killing the fetus.
State representative Larry Larranaga said, "He shot directly at the baby and killed it intentionally." He plans to ask the governor to put the matter on the agenda for the regular session coming up in January.
Four years ago, Larranaga introduced legislation aimed at protecting unborn victims of violence, but the bill failed to pass.
"I do believe it should be a triple homicide," said Agnes Maldonado, New Mexico Domestic Violence Coalition. Maldonado said the state law did not protect all the victims.
"It has technical legal elements to it that is the first step in undermining a woman's right to choose," said Maldonado. She also believes women should have a choice and in this case she said Sarah had already made her choice, which makes this situation different and even more tragic.
Larranga said he will keep fighting for his bill which he now plans of calling the Isaac victim's law... after the name Sarah Lovato had planned to call her child.
